ACA Information

On January 20, 2017, President Trump signed an executive order entitled, “Executive Order Minimizing the Economic Burden of the Patient Protection and Affordable Care Act Pending Repeal”. This Executive Order instructs all federal agencies to waive, defer, or grant exemptions from any provision in the Act that would impose a financial burden on individual taxpayers. Among other things, the Affordable Care Act (ACA) requires taxpayers to qualify for an exemption or purchase health insurance.  When taxpayers fail to purchase health insurance, they are required to make a “shared responsibility payment” with their tax return.  This is widely referred to as the “Individual Mandate”.

 The Internal Revenue Service has responded as follows:

 “Consistent with [the Executive Order], the IRS has decided to make changes that would continue to allow electronic and paper returns to be accepted for processing in instances where a taxpayer doesn’t indicate their coverage status. However, legislative provisions of the ACA law are still in force until changed by the Congress, and taxpayers remain required to follow the law and pay what they may owe‎.”

 Given that the ACA remains in effect until changed by Congress, we advise our clients to report health care information as required by law.  We expect Congress to act on the Executive Order and will keep our clients informed of any changes in the law.

India Busts Bogus Call Centers for Posing as the IRS

LONDON (CNNMoney) — Police in India have arrested 70 people on suspicion of posing as IRS agents to steal cash from U.S. citizens.

Authorities in the western Indian city of Thane said they were investigating another 630 people suspected of being involved in the extortion scam.

Workers at nine call centers allegedly impersonated IRS agents during calls to the U.S., according to local police commissioner Param Bir Singh. The victims were told they owed back taxes and would risk arrest if they hung up.

Singh told CNN the call center workers had been trained to speak with an American accent.

The call centers were making $150,000 a day for up to a year before being discovered. Money would be transferred by victims of the scheme to U.S. bank accounts before being sent to India.

Singh said the police had a mole inside the organization before the arrests were made, but he said the call center owners had escaped. He suspects that the fraudsters had accomplices in the U.S., but he has not yet made contact with American law enforcement officials.

The mechanics of the operation appear very similar to those of an IRS impersonation scam that U.S. authorities say swindled victims out of more than $15 million between 2013 and 2015.

In that case, investigators suspected the bogus calls were coming from India. The culprits stole identities to make it appear they were IRS agents in Washington.

“They have information that only the Internal Revenue Service would know about you,” Timothy Camus, deputy inspector general for investigations with the Treasury Department, told CNN last year. “It’s a byproduct of today’s society. There’s so much information available on individuals.”

More recently, Treasury Department investigators filed criminal complaints in the U.S. against five individuals in three states, accusing them of fleecing nearly $2 million from more than 1,500 victims as part of a scheme to impersonate IRS agents.

United Way – Bear River Head Start Day of Caring

JS was able to participate in the local Day of Caring through the United Way on Friday, September 16.  It was nice to get a few hands out there in the community and do something for a morning (besides punching numbers at a desk)!  Jones Simkins cares about the community and strives to take care of people while at their desk or outside the office!

Jones Simkins goes on Retreat!

After the river rafting adventure, we met up with Leslie, Reagan and Adam from our firm at the Flying Saddle Resort in Alpine for a nice dinner.  Those that couldn’t make it to either the river or the dinner were missed!  It was a very great day!!
