ACA Information

On January 20, 2017, President Trump signed an executive order entitled, “Executive Order Minimizing the Economic Burden of the Patient Protection and Affordable Care Act Pending Repeal”. This Executive Order instructs all federal agencies to waive, defer, or grant exemptions from any provision in the Act that would impose a financial burden on individual taxpayers. Among other things, the Affordable Care Act (ACA) requires taxpayers to qualify for an exemption or purchase health insurance.  When taxpayers fail to purchase health insurance, they are required to make a “shared responsibility payment” with their tax return.  This is widely referred to as the “Individual Mandate”.

 The Internal Revenue Service has responded as follows:

 “Consistent with [the Executive Order], the IRS has decided to make changes that would continue to allow electronic and paper returns to be accepted for processing in instances where a taxpayer doesn’t indicate their coverage status. However, legislative provisions of the ACA law are still in force until changed by the Congress, and taxpayers remain required to follow the law and pay what they may owe‎.”

 Given that the ACA remains in effect until changed by Congress, we advise our clients to report health care information as required by law.  We expect Congress to act on the Executive Order and will keep our clients informed of any changes in the law.
